J-beauty Hunt Community Terms and Conditions for residents of U.S./Canada

1) Who we are
-”J-beauty Hunt”, “Cosme Hunt,” “we,” “our,” and “us” mean Cosme Hunt, Inc., based in San Francisco, California, USA, and its group companies, including Trenders Inc. in Japan.
Cosme Hunt, Inc. acts as the data controller (the party that determines the purposes and means of processing) for personal information collected through the Community. Trenders Inc. serves as a data processor/service provider and handles such information solely on Cosme Hunt’s documented instructions.
2) What this agreement covers
- These Terms govern your participation in the J-beauty Hunt online community and any related programs (product seeding, brand projects, events, and opportunities).
- By applying to or participating in the community, you agree to these Terms and our Community Guidelines, and any additional rules we post for specific activities. If you do not agree, do not join or participate.
3) Eligibility
- You must be at least 18+ years old.
- You must be a resident of United States of America or Canada.
- You must provide accurate information and keep it up to date.
- We may accept or decline applicants at our sole discretion and may limit participation by region or other criteria.
4) Community benefits and opportunities
- Members may receive: opportunities to try J‑beauty products, collaborate with J‑beauty brands (including paid collaborations), connect with other J‑beauty fans, and access other opportunities we may announce.
- Selection for any product, event, or collaboration is not guaranteed. We may change, pause, or end opportunities at any time.
5) Paid collaborations (separate contracts)
- If Cosme Hunt, Inc. offers a paid assignment through this Service—such as a product-review post—the member shall enter into a separate services agreement with Cosme Hunt, Inc. that sets forth the compensation and all other applicable terms. Members are solely responsible for complying with all relevant tax laws and filing obligations.
- All terms for compensation, deliverables, usage rights, taxes, and timing will be defined in the separate collaboration agreement, which controls if there is any conflict with these Terms.
- You are responsible for complying with applicable disclosure and endorsement rules (for example, FTC endorsement guidelines in the U.S.) and any platform disclosure tools.
6) Data, privacy, and communications
- Application and community information you submit will be used for community-related purposes only (for example, selection for product seeding, communication about opportunities, shipping products, and administering the community).
Location of data and international transfers
Your personal information will be collected and stored in Airtable databases that are physically hosted in the United States and may be replicated to other countries where Airtable or its group companies operate data centers. In addition, Cosme Hunt, Trenders, and our other service providers may process your information in the United States, Japan, and any other country in which we operate. By joining the Community, you expressly consent to this transfer, storage, and processing of your information outside your country of residence, acknowledging that such jurisdictions may have data-protection laws that differ from those in your jurisdiction.

- By joining, you consent to receive community-related emails/messages. You may opt out of non-essential marketing emails at any time, but you may still receive essential communications (for example, program updates or legal notices).
7) Shipping, products, and safety
- If you are selected to receive products:
- You must provide accurate shipping details and notify us of changes.
- Products are provided for personal use, testing, or content creation as indicated; not for resale.
- Risk of loss transfers upon delivery to your provided address or local pickup point.
- International shipments may involve customs duties, taxes, and delays; unless we specify otherwise in writing, you are responsible for duties and taxes.
- Skincare and cosmetics can cause reactions. Patch test first, review ingredient lists, and discontinue use if irritation occurs. The content we provide is informational only and not medical advice. Consult a professional if needed.
8) Your content and license to us
- “User Content” includes any posts, photos, videos, reviews, comments, survey responses, testimonials, and other material you share with the community or submit to us in relation to the community (excluding confidential materials provided to you under a separate agreement).
- You retain ownership of your User Content. You grant Cosme Hunt and our group companies a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform and display, and create derivative works from your User Content in connection with the community, our websites, social channels, marketing, and brand projects. This license lasts for as long as the content is protected by intellectual property rights and may be sublicensed to brand partners solely for the above purposes.
- Do not submit content you don’t have the right to share, and do not include confidential information unless we specifically request it via a secure channel and mark it as confidential.
9) Brand briefs and confidentiality
- You may receive non-public information from Cosme Hunt or brand partners (for example, briefs, campaign details, unreleased product information). Treat such information as confidential and use it only as instructed. Do not disclose or share confidential materials without written permission.
- Separate collaboration agreements may include additional confidentiality obligations that will control.
10) Intellectual property rights
- Cosme Hunt/J-beauty Hunt names, logos, and trademarks are owned by Cosme Hunt and may not be used without permission.
- Respect the intellectual property rights of others. If you believe content infringes your rights, contact us at [Insert IP complaint email]. Include your contact details, a description of the content, the location, and a statement of good-faith belief of infringement.
11) Feedback
- If you submit feedback or suggestions, you grant us the right to use them without restriction or compensation.
12) Termination
- You may leave the community at any time by notifying us at support@cosmehunt.com.
- We may suspend or terminate your participation at any time with or without notice, including for violations of these Terms or the Community Guidelines.
- Sections that by their nature should survive (for example, licenses to content already used, confidentiality, disclaimers, limitation of liability, and governing law) will survive termination.
13) Disclaimers
- The community and any opportunities are provided “as is” and “as available.” We do not guarantee availability, selection, outcomes, or results.
- We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non‑infringement.
14) Limitation of liability
- To the fullest extent permitted by law, Cosme Hunt and its group companies will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or data.
15) Indemnification
- You agree to defend, indemnify, and hold harmless Cosme Hunt, our group companies, and partners from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your User Content, or your unlawful conduct.
16) Governing law and venue
- These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
- The exclusive venue for disputes is the state or federal courts located in San Francisco County, California, unless the parties agree otherwise in writing. You consent to personal jurisdiction in those courts.
17) Changes to these Terms
- We may update these Terms. If we make material changes, we will provide reasonable notice (for example, by email or in-platform notice). Your continued participation after changes become effective means you accept the updated Terms.
